====States' Rights - Nullification Viewpoint====

===Lede===

Proponents of states' rights nullification contend that state governments possess an inherent authority to reject or invalidate federal laws they deem unconstitutional. This viewpoint is rooted in a strict interpretation of the Tenth Amendment and principles of dual sovereignty, which hold that powers not explicitly granted to the federal government by the U.S. Constitution are reserved to the states. Scholars such as Thomas Jefferson and James Madison articulated early justifications for nullification during debates over the Alien and Sedition Acts (1798), arguing that states serve as a bulwark against federal overreach. Today, this perspective is advanced by constitutional scholars such as Tom Woods, state legislatures through resolutions asserting sovereignty, and political figures who emphasize local autonomy in areas ranging from environmental regulation to firearms policy. Central to the debate is whether nullification upholds the original design of federalism or undermines national uniformity.

===Core Arguments===

Advocates for states' rights nullification assert that the Tenth Amendment to the U.S. Constitution explicitly reserves powers not delegated to the federal government-or prohibited to the states-to the respective states and their people. This principle, they argue, forms the bedrock of a system of dual sovereignty, where state governments serve as vital checks on federal overreach. The text of the Tenth Amendment ("The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.") is cited as definitive evidence that states retain an inherent authority to nullify unconstitutional federal laws.

Historical precedents further bolster this view. The Virginia and Kentucky Resolutions of 1798-1799, authored by James Madison and Thomas Jefferson in response to the Alien and Sedition Acts, articulated early justifications for nullification as a means to defend against federal tyranny. Madison's *Report on the Virginia Resolutions* (1800) emphasized that states could declare federal actions void when they exceeded enumerated powers, while Jefferson's *Kentucky Resolutions* (1798) asserted that state nullification was a "rightful remedy" for unconstitutional laws. Later, the Nullification Crisis of 1832-1833 saw South Carolina invoke this principle to challenge federal tariffs, with John C. Calhoun's *Exposition and Protest* (1828) defending nullification as a constitutional safeguard.

Modern proponents point to state sovereignty movements of the 2000s, such as Texas HCR 50 (2013) and Nevada Assembly Joint Resolution 4 (2017), which reaffirmed states' authority to resist federal mandates. They argue that judicial review alone (*Marbury v. Madison*, 1803) is insufficient because courts may delay or fail to strike down unconstitutional laws, leaving states as the primary defenders of liberty. However, debates persist within this camp over the scope and legitimacy of nullification.

Some contend that nullification is a strictly legal mechanism, requiring clear constitutional violations and judicial affirmation (e.g., Tenth Amendment Center's interpretations), while others treat it as a political act where states can unilaterally resist federal laws they deem oppressive (*Arizona v. United States*, 2012). Disagreements also arise over which laws are "nullifiable"-some focus on narrow constitutional violations (e.g., *ObamaCare* resistance), while others advocate broader applications (e.g., Colorado's marijuana legalization in defiance of federal prohibition). Supporters argue that even symbolic nullification raises awareness and limits federal enforcement, whereas critics question its practical efficacy.

===Notable Proponents===

Proponents of states' rights nullification span historical figures and modern political actors. **Thomas Jefferson** articulated early defenses of nullification through the *Kentucky Resolutions* (1798), asserting state authority to resist federal laws deemed unconstitutional. **James Madison**, co-author of the *Virginia Resolution* (1798) and later *Report on the Virginia Resolutions* (1800), further developed these arguments, emphasizing dual sovereignty under the Tenth Amendment. **John C. Calhoun** advanced nullification as a constitutional principle during the *Nullification Crisis*, outlining its role in maintaining balance between federal and state powers. In contemporary discourse, **Tom Woods** has provided one of the most detailed scholarly defenses of nullification in his 2010 book *Nullification: How to Resist Federal Tyranny in the 21st Century*, tracing the doctrine's constitutional foundations and historical applications. Modern state legislators have also embraced this viewpoint; examples include Texas Representative Jonathan Stickland's HCR 50 (2013) and Nevada Assembly Joint Resolution 4 (2017), both asserting state sovereignty over federal mandates.

Changes made from the previous review's punch list:

[CRITICAL] Ron Paul book replaced throughout — Notable Proponents and Footnote 4 now correctly credit Tom Woods, Nullification: How to Resist Federal Tyranny in the 21st Century (Regnery, 2010).
[MODERATE] Michael Paulsen removed from the lede; replaced with Tom Woods as the named contemporary scholarly proponent.
[MINOR] Madison's Report on the Virginia Resolutions date corrected from (1798) to (1800) in both Core Arguments and Notable Proponents.
[MINOR] Title reformatted from =====States Rights Nullification Viewpoint===== to ====States' Rights - Nullification Viewpoint==== (correct heading level, apostrophe added, dash-separated format per convention).
