Shelby County v. Holder
//Shelby County v. Holder//, 570 U.S. 529 (2013), is a landmark United States Supreme Court decision in which a five-justice majority struck down Section 4(b) of the Voting Rights Act of 1965, the formula used to determine which states and localities were subject to the federal preclearance requirement under Section 5. The ruling did not invalidate Section 5 itself, but rendered it inoperable by eliminating the coverage formula that defined its scope. The decision is among the most consequential in modern voting rights law and remains the subject of sustained legal, political, and academic controversy.

Background
The voting-rights-act-1965 was enacted by Congress to address systematic disenfranchisement of black voters, particularly in the South. Section 5 required covered jurisdictions to obtain federal approval - "preclearance" - before implementing any change to voting laws or procedures. Section 4(b) established the formula identifying covered jurisdictions, based primarily on low voter registration or turnout in the 1964, 1968, or 1972 presidential elections and the use of a "test or device" as a condition of voting.

Shelby County, Alabama, filed suit in the U.S. District Court for the District of Columbia in 2010, arguing that both Section 5 and Section 4(b) exceeded Congress's constitutional authority and violated principles of equal state sovereignty. The district court upheld the provisions, and the D.C. Circuit Court of Appeals affirmed. The Supreme Court granted certiorari and issued its decision on 25 June 2013.

The Decision
Chief Justice John Roberts, writing for the majority, held that Section 4(b)'s coverage formula was unconstitutional under the Fourteenth and Fifteenth Amendments because it was based on decades-old data and conditions that no longer reflected current circumstances. The majority invoked the equal-sovereignty-doctrine, a principle holding that the Constitution requires Congress to treat states with equal dignity and that any departure from that principle must be justified by current needs. The Court found that conditions in covered jurisdictions had changed sufficiently since 1965 that the existing formula could not be sustained.

The majority declined to strike down Section 5 directly, instead holding that Congress could draft a new, constitutionally adequate coverage formula if it chose to do so.

Justice Ruth Bader Ginsburg, joined by Justices Breyer, Sotomayor, and Kagan, dissented. Ginsburg argued that the majority misapplied the standard of deference owed to Congress in enforcing the fifteenth-amendment, that the record before Congress at the time of reauthorization in 2006 amply supported continued preclearance coverage, and that the majority's equal sovereignty rationale was novel and unsupported by precedent. Her dissent characterized the decision as analogous to "throwing away your umbrella in a rainstorm because you are not getting wet."

Current State of Debate
Following the decision, covered jurisdictions were immediately freed from the preclearance requirement. Several states enacted or enforced election laws - including voter-id-laws and changes to early voting procedures - that had previously been blocked or modified under preclearance review. Supporters of the decision argue that those developments reflect states exercising legitimate authority over their own elections. Critics argue that subsequent voting changes have produced discriminatory effects that preclearance would have prevented.

Congress has not enacted a new coverage formula as of this writing. Legislation to restore and expand the Voting Rights Act, including the John Lewis Voting Rights Advancement Act, has passed the House on multiple occasions but has not cleared the Senate.

The scope of Section 2 of the Voting Rights Act - which prohibits voting practices that result in the denial or abridgment of voting rights on account of race, and which was not addressed in //Shelby County// - has become a subsequent focal point of litigation and debate. The Supreme Court's later decision in brnovich-v-democratic-national-committee (2021) addressed the standard for Section 2 challenges to facially neutral voting rules, further shaping the post-//Shelby County// legal landscape. That scope remains actively contested. See voting-rights-act-1965-viewpoint-section-2-scope-debate.

Viewpoints
Multiple distinct positions are represented in legal, academic, and policy debate over //Shelby County//.

**The decision correctly applied constitutional limits on federal power.** This view holds that the preclearance regime imposed a substantial burden on state sovereignty that could only be justified by exceptional and current evidence of discrimination; that the 2006 reauthorization relied on stale data; and that the equal sovereignty principle appropriately constrains disparate federal treatment of states. See voting-rights-act-1965-preclearance-outdated-viewpoint.

**The decision improperly curtailed a valid exercise of congressional enforcement power.** This view holds that the Fourteenth and Fifteenth Amendments grant Congress broad authority to determine the means appropriate to prevent voting discrimination; that the Court substituted its own factual judgment for Congress's documented findings; and that the equal sovereignty rationale was applied selectively and without textual grounding. See voting-rights-act-1965-federalism-viewpoint.

**The decision reflects a legitimate federalism principle but was applied too broadly.** Some scholars accept that the coverage formula had become outdated while criticizing the majority's articulation of equal sovereignty as an independent constitutional constraint, arguing it may have unintended consequences in other areas of federal-state relations.

**The legal consensus on the VRA supports the dissent's approach.** This view holds that the preponderance of constitutional scholarship, historical analysis, and judicial precedent prior to //Shelby County// supported broad congressional power to enforce the Reconstruction Amendments, and that the majority's holding represents a significant departure. See voting-rights-act-1965-legal-consensus.

Controversies
**Equal sovereignty doctrine.** The majority's reliance on the equal sovereignty of states was characterized by critics as a novel and expansive constitutional principle applied selectively to voting rights law; its scope and precedential implications remain disputed. See equal-sovereignty-doctrine.

**Post-decision voting changes.** The removal of preclearance requirements prompted immediate litigation over voting law changes in formerly covered jurisdictions, generating ongoing controversy over whether those changes reflect legitimate state authority or facilitated discrimination.
