====== Franklin Roosevelt - Libertarian Viewpoint ======

The libertarian viewpoint holds that Franklin Delano Roosevelt, the 32nd President of the United States, was the figure most responsible for transforming the American republic from a constitutionally limited government into an unbound administrative and regulatory state. Adherents of this view-drawing on the Austrian and Chicago schools of economics, Old Right anti-statism, and modern libertarian legal scholarship-argue that Roosevelt's New Deal failed on its own economic terms, that his court-packing scheme and regulatory expansion did lasting damage to constitutional limits on federal power, and that his administration's record on civil liberties, most starkly the internment of Japanese Americans, was authoritarian rather than merely a wartime aberration. Libertarians do not generally treat Roosevelt as a singular villain; rather, they see him as the president who most effectively and permanently institutionalized the progressive abandonment of constitutional restraint that began under Woodrow Wilson, exploiting a crisis to entrench a permanent expansion of executive and federal power.

===== Core Arguments =====

==== The New Deal did not end the Depression ====

The central libertarian claim is empirical: New Deal policies did not produce recovery and likely prolonged the Depression. Economists working in this tradition-Robert Higgs, Richard Vedder and Lowell Gallaway, Burton Folsom, and Jim Powell among them-point out that unemployment remained in double digits through the late 1930s, and that the median jobless rate across the New Deal years stayed above 14 percent.((Jim Powell, FDR's Folly: How Roosevelt and His New Deal Prolonged the Great Depression (New York: Crown Forum, 2003).)) Robert Higgs's "regime uncertainty" thesis holds that the unpredictability of New Deal policy-the National Industrial Recovery Act's price-fixing codes, threats to property rights, and erratic monetary moves like the gold-clause abrogation-deterred the private investment needed for genuine recovery, and that sustained recovery only came after wartime controls were lifted and businesses regained confidence that property rights would be respected.((Robert Higgs, "Regime Uncertainty: Why the Great Depression Lasted So Long and Why Prosperity Resumed after the War," The Independent Review 1, no. 4 (Spring 1997): 561-590.)) Many in this camp also argue, following more recent monetary-history scholarship, that the Depression's depth and length owed primarily to Federal Reserve and gold-standard failures predating Roosevelt, meaning the New Deal addressed a crisis it did not cause and worsened it rather than curing it.((Libertarianism.org, "New Deal: A Libertarianism.org Guide," accessed June 2026, https://www.libertarianism.org/topics/new-deal.))

==== Roosevelt centralized power beyond constitutional limits ====

Libertarian legal scholars in the [[constitutional-originalism|originalist]] and libertarian-constitutionalist traditions, including Georgetown's Randy Barnett and the Institute for Justice, argue that the New Deal's most lasting harm was doctrinal: it produced a body of Supreme Court precedent-above all the post-1937 expansion of the Commerce Clause and the near-total abandonment of enumerated-powers limits on federal economic regulation-that has allowed Congress to regulate almost any activity under a pretext of interstate commerce ever since.((Damon Root, "The Rehabilitationists: The Libertarian Movement to Undo the New Deal," The New Republic, March 24, 2015, https://newrepublic.com/article/122645/rehabilitationists-libertarian-movement-undo-new-deal.)) On this view, Roosevelt's 1937 plan to add justices to the Supreme Court-nominally a response to the Court striking down New Deal measures such as the NIRA in Schechter Poultry and a New York minimum-wage law-was a direct assault on judicial independence as a check on executive and legislative power. Although the plan failed in Congress, the "switch in time" that preceded and followed it left the judiciary far more deferential to federal economic regulation, a deference libertarians regard as the New Deal's most consequential and least examined legacy.((Root, "The Rehabilitationists.")) Libertarians also point to Roosevelt's seizure of gold and abrogation of gold-denominated contracts in 1933 as a precedent-setting violation of contract and property rights by executive fiat.

==== The New Deal state was used to punish dissent ====

A distinct strand of the libertarian critique, developed at length by historian David Beito in The New Deal's War on the Bill of Rights and his subsequent FDR: A New Political Life, holds that the Roosevelt administration weaponized the new federal apparatus-including tax audits by the Bureau of Internal Revenue and investigations by the Senate Special Committee on Lobbying-against political opponents, journalists, and critics of the administration.((David T. Beito, The New Deal's War on the Bill of Rights: The Untold Story of FDR's Concentration Camps, Censorship, and Mass Surveillance (Oakland: Independent Institute, 2023).)) Libertarians cite this pattern, sometimes called the "Black Inquisition" after Senator Hugo Black's lobbying investigations, as evidence that centralizing economic power inevitably invites its use against civil liberties, and note that opposition to these tactics drew support from civil libertarians across the political spectrum, including the progressive Amos Pinchot.((Aaron Ross Powell, "Everything Wrong with the Franklin D. Roosevelt Administration," Libertarianism.org, March 1, 2024, https://www.libertarianism.org/articles/everything-wrong-franklin-d-roosevelt-administration.)) The internment of Japanese Americans under Executive Order 9066 is treated in this literature not as an isolated wartime lapse but as the clearest expression of an administration broadly comfortable overriding individual rights when it judged the ends sufficient.

==== Social Security and labor policy harmed the people they claimed to help ====

Libertarian economists such as Burton Folsom argue that Social Security payroll tax increases for middle-class and working-class workers outpaced the wage gains New Deal labor law was supposed to guarantee them, leaving many workers with less real income than before. Jim Powell's broader argument, frequently cited in this literature, holds that New Deal policies-bank consolidation that disadvantaged small rural banks, agricultural price supports that raised food costs, and minimum-wage and labor laws that priced low-skilled workers, including a disproportionate share of black workers, out of jobs-did particular harm to the poor, the rural, and racial minorities, even though the New Deal is conventionally credited as a triumph for those same groups.((Jim Powell, FDR's Folly.)) Libertarians acknowledge this is a contested empirical claim and that liberal historians dispute it, but hold that it is a necessary corrective to an uncritical popular narrative.

===== History and Development of the Viewpoint =====

Libertarian criticism of Roosevelt began during his presidency itself, among so-called Old Right figures who saw the New Deal as the culmination of a progressive project to dismantle constitutional limits on government that had begun under Wilson. Albert Jay Nock, an individualist and civil libertarian whose Our Enemy, The State (1935) argued that state power inherently expands at the expense of social cooperation, charged that Roosevelt advised Congressmen "not to be too particular about the constitutionality of a measure which interests him."((David Gordon, "FDR against the Bill of Rights," Mises Institute, April 5, 2024, https://mises.org/friday-philosophy/fdr-against-bill-rights.)) H. L. Mencken and the journalists around Nock's magazine The Freeman pressed similar themes. This Old Right current fed into the postwar free-market and libertarian movement associated in part with the Foundation for Economic Education, and later into the explicitly Austrian-school critique developed by Murray Rothbard, whose America's Great Depression (1963) blamed the Depression's onset on pre-Roosevelt Federal Reserve policy while treating the New Deal as an aggravating intervention.

A second wave of scholarly reassessment followed Ronald Reagan's 1980 election, which renewed interest in revisiting New Deal economic history; this produced the body of work by Higgs, Vedder, Gallaway, Folsom, and Powell that forms the empirical core of the contemporary critique.((Wikipedia, s.v. "Criticism of Franklin D. Roosevelt," accessed June 2026, https://en.wikipedia.org/wiki/Criticism_of_Franklin_D._Roosevelt.)) A parallel legal-academic movement, sometimes called the constitutional "rehabilitationists," emerged from the 1980s onward around scholars such as Randy Barnett and institutions such as the Cato Institute and the Institute for Justice (founded 1991), seeking to revive pre-New Deal limits on the Commerce Clause and economic regulation through litigation and legal scholarship.((Root, "The Rehabilitationists.")) Most recently, David Beito's archival work has shifted the civil-liberties critique from the margins of the literature toward its center, reframing Roosevelt's record on free speech, privacy, and due process as a defining rather than peripheral feature of his presidency.

===== Internal Debates =====

Libertarians are not unanimous on every count. Some, particularly those most influenced by Higgs's monetary-history framing, place the greater share of blame for the Depression's severity on Federal Reserve and gold-standard failures predating Roosevelt, treating the New Deal mainly as an aggravating rather than originating cause; others, closer to the Rothbardian tradition, see New Deal-style intervention as continuous with the interventionist errors that caused the crash in the first place, making Roosevelt's program an intensification of the same error rather than a distinct one. There is also debate over emphasis: some libertarian critics, especially those writing in legal and constitutional venues, treat the Commerce Clause and judicial-independence questions as Roosevelt's most consequential legacy, while others, following Beito, argue the civil-liberties record deserves at least equal weight and has been comparatively neglected. A further minor disagreement concerns Roosevelt's foreign policy and entry into World War II, with some libertarians in the non-interventionist tradition extending their critique of his domestic centralization to his wartime conduct, while others treat the war as a separate question from the New Deal proper.
