=====Fourteenth Amendment Equal Protection - History=====
The Equal Protection Clause of the Fourteenth Amendment has been a cornerstone of American constitutional law since its ratification in 1868. This article explores its historical development, from post-Civil War debates to modern controversies over its interpretation. For broader context on the amendment, see [[fourteenth-amendment]]. Key legal landmarks include the [[plessy-v-ferguson-viewpoint-diversity]] case, which established "separate but equal," and [[brown-v-board-of-education-living-constitutionalism-viewpoint]], which overturned it.

===Lede===
This article traces the historical development of the Equal Protection Clause (14th Amendment). For a comprehensive overview of the amendment, see our main page on the [[fourteenth-amendment]]. The evolution of equal protection jurisprudence is deeply intertwined with landmark cases like [[plessy-v-ferguson-viewpoint-diversity]], which introduced "separate but equal," and [[brown-v-board-of-education-living-constitutionalism-viewpoint]], which marked its demise.

===Early History===
The Equal Protection Clause emerged from the turbulent Reconstruction era following the Civil War. Congress and the states debated its meaning as part of a broader effort to secure civil rights for formerly enslaved individuals. Senator Jacob Howard, a key architect of the Fourteenth Amendment, argued that "equal protection" would guarantee federal safeguards against state discrimination. However, early Supreme Court decisions like the [[slaughter-house-cases-history]] (1873) limited the amendment's scope by emphasizing states' police powers over federal intervention.

The Civil Rights Act of 1875 sought to outlaw racial discrimination in public accommodations and transportation, but the Court invalidated it in the Civil Rights Cases (1883), signaling a narrowing of federal authority under the amendment. Meanwhile, Justice John Marshall Harlan's dissent in [[plessy-v-ferguson-viewpoint-diversity]] (1896) foreshadowed future debates by condemning racial segregation as unconstitutional. The Freedmen's Bureau debates further illuminated congressional intent, with some lawmakers advocating for stronger protections to prevent state-sponsored inequality.

===Development===
The late 19th and early 20th centuries saw the rise of legal strategies to challenge "separate but equal." Cases like *Kumamoto v. Commonwealth* (1903) and *Mendez v. Westminster* (1946) laid groundwork for later victories by questioning segregation's constitutionality in education and public services. The [[shelley-v-kraemer-state-action-viewpoint]] decision (1948) expanded the state action doctrine, clarifying that private discrimination could be regulated if enabled by state law.

The [[brown-v-board-of-education-living-constitutionalism-viewpoint]] ruling (1954) marked a turning point by overturning *Plessy* and declaring segregation in schools unconstitutional. The NAACP's litigation strategy, combined with shifting judicial attitudes, propelled the Court toward a broader interpretation of equal protection. By the 1960s, the Warren Court applied the clause to race-based classifications, while the Burger Court extended its reach into gender discrimination cases like *Reed v. Reed* (1971).

===Modern Period===
The latter half of the 20th century saw the Equal Protection Clause become a central vehicle for civil rights jurisprudence. The Warren and Burger Courts refined standards of review, applying strict scrutiny to racial classifications and intermediate scrutiny to gender-based laws. The application and limits of these standards were elaborated in cases such as *Loving v. Virginia* (1967) and *Craig v. Boren* (1976). Recent rulings on affirmative action, such as [[fisher-v-texas-affirmative-action-viewpoint]] (2016) and *Students for Fair Admissions v. Harvard* (2023), reflect ongoing debates over remedial measures versus colorblind interpretations.

The clause's evolution also includes controversies over its original intent, with some scholars arguing for a more limited scope based on 19th-century debates, while others advocate for living constitutionalism to address contemporary inequalities.

===Controversies===
Some historians argue that [[plessy-v-ferguson-viewpoint-diversity]] was wrongly decided and that *Brown v. Board of Education* correctly interpreted the Equal Protection Clause, though critics contend *Brown* overreached.
The original intent of "equal protection" remains debated, with disputes over whether it applied to private discrimination before [[shelley-v-kraemer-state-action-viewpoint]].
The extent and proper application of strict scrutiny versus intermediate scrutiny standards continue to divide legal scholars.
